What is Article 35-A and Why it is a topic of discussion for Kashmir?

Former IAS officer and President of the Jammu and Kashmir People's Movement, Shah Faisal, on Saturday, expressed concern over the deployment of additional Central security forces in Jammu and Kashmir and said that there is a rumour that something bigger is going to happen in the valley.

After this, speculation started that the Central Government is going to end Article 35-A. The state also started. Mehbooba Mufti said that tampering with ammunition is equivalent to handling gunpowder.

All the Kashmiri leaders, including Omar Abdullah, advised avoiding any tampering with the 35-A.

Article 35A gives special rights to the state. Also, if we talk about Article 370, Jammu and Kashmir has a State status. The Government of India wants to abolish the rights that Jammu and Kashmir get from these Articles.

But what is Article 35 A? Why people are raising voice to remove it?  And if it is removed then why Kashmir’s political leaders are objecting for it?

Why is it a topic of discussion?
The matter was going on in Supreme Court; however, the decision is not out yet. Five years ago, the petition was filed against Article 35-A. Since then, this matter has remained the centre of discussion in the country and the opposition in Kashmir. In this case, it is necessary to understand that Article 35-A of the Constitution related to Kashmir and why it is being said is the root of separatism in Kashmir.

Those people have been a citizen of Jammu and Kashmir on 14 May 1954 or have been living here for the past 10 years and have made their property, they can become permanent citizens.

What is the reason for the removal of Article 35A?
First, it was not implemented through Parliament and at the time of the partition of India, a large number of people from Pakistan entered India, those of them who are in Jammu and Kashmir have also received citizenship of them. Under Article 35A, the Jammu and Kashmir government denied the permanent resident certificate of 80 per cent backwards and Indian citizens of Dalit Hindu community. At the same time, under the aegis of Article 35A of the Jammu and Kashmir government, there is a rabbet with those people who marry and women come here.

Article 35A was passed by the then President Dr Rajendra Prasad on May 14, 1954.

Under this article, a person residing in any other state of India can not vote due to not being a permanent resident of Jammu Kashmir. Also, the person living in another state can not buy the land here. If a girl born in Jammu and Kashmir gets married in another state, then all rights are taken from her. Along with that, her children did not have any right.
